Adani to pay 18% GST on staff cost dues to AAI, exempted for Jaipur airport business transfer


The Authority for Advance Ruling has ruled that the transfer of Jaipur international airport operations by the Airports Authority of India (AAI) to the Adani group is exempt from Goods and Services Tax (GST). The AAI sought a ruling from the Rajasthan-bench of the AAR on whether the transfer of business to M/s Adani Jaipur International Airport Ltd is considered a supply as a “going concern” and if GST is applicable to the transfer of assets. Under GST law, the transfer of business as a going concern, as a whole or in part, is treated as a service and is exempt from GST.
